THE PARTIES

This document, "Terms of Service - callcheap", hereafter referred to as the "Terms", agrees between

hereafter referred to as "callcheap",

and

the person or party identified in the associated registration form or reseller contract, hereafter referred to as "Customer", the following:

These Terms relate to communications services offered by callcheap for use by the Customer, and defines the terms and conditions under which these services are provided by callcheap and accepted and used by the Customer.

SERVICE

callcheap provides the Customer with the ability to make telephone calls through Voice-over-IP and access numbers.

No emergency calls: by entering into these Terms the Customer acknowledges and agrees that the callcheap infrastructure does not and does not intend to support or carry emergency calls.

Calls to special numbers, which are neither landline nor mobile numbers, such as premium or service numbers are not possible via callcheap.

callcheap cannot provide a fault free service. callcheap provides no warranty that its network or services shall be continuous or will be free from faults.

callcheap shall not be liable for any indirect, incidental, special or consequential damages or for interrupted communications, lost data, or loss of profit, or economic loss arising out of or in connection with these Terms and in particular shall not be liable for any delay in rectification of any such problem.

The service is provided for the individual use by the Customer. The Customer shall not resell or commercialise the service to any third party without a prior, written consent by callcheap.

The Customer is not allowed to use the service for or on:

(i) illegal or law-violating purposes,
(ii) telemarketing or call centre operations,
(iii) calling numbers to generate income for the Customer or others as a result of merely placing the call; other than for the Customers individual business communications,
(iv) unusual calling patterns inconsistent with normal, individual use, for example, regular calls of short duration or calls to multiple numbers in a short period of time,
(v) calls to premium numbers (such as 900).

FAIR USAGE

In addition, the following is valid for flatrate and included minutes packages:

The flatrate and included minutes packages, hereafter called subscriptions, allow unlimited or a limited amount of calls or minutes to landlines (and mobiles in certain countries) in the applicable subscription countries, excluding special, premium, service and non-geographic numbers. The Customer is not allowed to use subscriptions for, on or if:

(i) re-selling subscription minutes,
(ii) sharing subscriptions between users whether via a PBX, call centre, computer or any other means.

Other practices may be relevant in determining legitimate use and callcheap reserves the right to take any unlawful, prohibited, abnormal or unusual activity into account in making its determination. callcheap may at its option, terminate its relationship with the Customer, or may suspend the Customers subscription immediately if it determines the Customer is using the subscription contrary to this fair usage policy or these Terms. Where reasonable, callcheap will provide the Customer with notice of improper usage before suspension or termination of the subscription and, if appropriate, callcheap may offer the Customer an alternative subscription.

callcheap reserves the right to withdraw or change the subscriptions at any time. If callcheap changes the services included in the subscription, callcheap will notify the Customer by email stating the changes and their effective date. If the Customer does not wish to accept these changes, the Customer is entitled to terminate the subscription, with effect from the date on which the changes are due to take effect.

PAYMENTS

If the Customer pays by credit card the paid fee will be charged to the credit card holders card instantly after successful payment.

TERM

All services are provided on a pre-paid basis. There is no minimum contract term. The Customer can ask for deactivation of his account by sending an E-Mail to callcheap@customercontrol.net

Court of jurisdiction is Frankfurt am Main, Germany.
